Terms of Use

These Terms of Use (the “Terms”) are the agreement and end-user licence between you andMitux LLC (“we”, “us”), the maker of SeaWindow, for your use of the app. By downloading or using SeaWindow, you agree to these Terms. If you do not agree, do not use the app.

Safety notice — please read. SeaWindow is an information tool, not a safety device. Its forecasts, indices and “go / caution” guidance are estimates built from third-party data that can be delayed, incomplete, or wrong, and conditions on the water change quickly and can differ from any forecast. SeaWindow is not a substitute for official forecasts and warnings from the National Weather Service or the U.S. Coast Guard, for proper marine equipment, or for your own judgement and local knowledge. You are solely responsible for deciding whether to go out, for your vessel, equipment and everyone aboard, and for following all applicable laws and regulations. Never rely on SeaWindow alone for any decision affecting safety of life.

Your licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to useSeaWindow on devices you own or control, for your own non-commercial use, subject to these Terms and the app store’s rules.

Your account

An account is optional. If you create one, you are responsible for the activity under it. Tell us promptly if you believe it has been used without your permission. You may delete your account at any time — see the Privacy Policy.

Acceptable use

Please do not misuse the app: do not attempt to break, overload, or gain unauthorized access to it or our servers; do not reverse-engineer or copy it except as the law allows; and do not use it to break the law. We may suspend access that threatens the service or other users.

Subscriptions and payments

SeaWindow is currently free to download and use. The terms below apply if and when paid plans are introduced.

We may offer paid features or auto-renewing subscriptions in the future. If we do, the price and what is included will be shown in the app before you buy. Payment is charged to your Apple App Store or Google Play account when you confirm the purchase.

Auto-renewing subscriptions renew automatically for the same period unless you cancel at least 24 hours before the current period ends, and your account is charged for renewal within 24 hours before the period ends. You can manage or cancel a subscription anytime in your App Store or Google Play account settings; cancellation takes effect at the end of the current period. Any unused portion of a free period is forfeited when you buy a subscription. Refunds are handled by Apple or Google under their policies; we generally cannot issue store refunds directly.

Data sources and attribution

Weather data is provided by Open-Meteo.com under CC-BY 4.0. Buoy, tide and marine-warning data are from the U.S. National Oceanic and Atmospheric Administration (NOAA) and its services (NWS, NDBC, CO-OPS) and are in the public domain. These sources do not endorse SeaWindow.

Our content

The app, its design, code, name and marks belong to Mitux LLC, except for third-party data and materials that belong to their owners. These Terms do not give you rights in our brand.

Warranty disclaimer

The app is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and accuracy of data, to the fullest extent the law allows.

Limitation of liability

To the fullest extent permitted by law, Mitux LLC will not be liable for any indirect, incidental, or consequential loss, or for loss or damage arising from your use of — or reliance on — the app or its data, including any decision to go out on the water. Nothing in these Terms limits liability that cannot be limited by law.

Indemnity

You agree to cover reasonable claims and costs that arise from your misuse of the app or your breach of these Terms.

Changes and termination

We may change, suspend, or discontinue the app or any feature at any time. We may end your access if you breach these Terms. You may stop using the app at any time.

Apple App Store

If you use SeaWindow on an Apple device, these Terms are between you and Mitux LLC only, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support. To the maximum extent permitted by law, Apple has no warranty obligation for the app; for a paid app, if it fails to conform to any applicable warranty you may notify Apple and Apple may refund the purchase price, and Apple has no other warranty obligation. Apple is not responsible for addressing any claim that the app or your use of it infringes intellectual-property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated “terrorist-supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws rules.

Changes to these Terms

If these Terms change, the “last updated” date above changes with it. Continuing to use the app after a change means you accept the updated Terms.

本《使用条款》（下称「条款」）是你与 SeaWindow 的制作方 Mitux LLC（下称「我们」）之间，就你使用本 App 达成的协议及最终用户许可。下载或使用 SeaWindow，即表示你同意本条款。若不同意，请勿使用本 App。

安全须知——请务必阅读。SeaWindow 是信息工具，不是安全设备。它的预报、指数和「可去 / 谨慎」提示，是基于可能延迟、不完整或有误的第三方数据得出的估计；海上情况变化很快，可能与任何预报不同。SeaWindow不能替代美国国家气象局（NWS）或美国海岸警卫队的官方预报与警报，也不能替代 合规的船舶装备，或你自己的判断与本地经验。是否出海、你的船只与装备、船上每个人的安全，以及遵守一切 适用法律法规，均由你自行负责。切勿仅凭 SeaWindow 做出任何关乎生命安全的决定。

你的许可

我们授予你一项个人的、有限的、非独占的、不可转让的、可撤销的许可，允许你在你拥有或控制的设备上， 为自己的非商业用途使用 SeaWindow，但须遵守本条款及应用商店的规则。

你的账号

账号是可选的。若你创建账号，须对该账号下的活动负责。如你认为账号被他人未经许可使用，请及时告知我们。 你可随时删除账号——见隐私政策。

可接受使用

请勿滥用本 App：不得试图破坏、超载或未经授权访问本 App 或我们的服务器；除法律允许外，不得逆向工程或 复制；不得用于违法用途。对于威胁到服务或其他用户的访问，我们可予以暂停。

订阅与付费

SeaWindow 目前免费下载和使用。以下条款在推出付费方案时适用。

我们未来可能提供付费功能或自动续订的订阅。若推出，购买前会在 App 内显示价格与所含内容。确认购买时， 费用将记入你的 Apple App Store 或 Google Play 账户。

自动续订的订阅会按相同周期自动续期，除非你在当前周期结束前至少 24 小时取消；续订费用会在当前周期结束 前 24 小时内扣取。你可随时在 App Store 或 Google Play 的账户设置中管理或取消订阅，取消将在当前周期结束 时生效。购买订阅时，免费期未使用的部分即告作废。退款由 Apple 或 Google 依其政策处理，我们通常无法直接 办理商店退款。

数据来源与署名

天气数据由 Open-Meteo.com 依 CC-BY 4.0 提供。浮标、潮汐和海洋警报数据来自美国国家海洋和大气管理局 （NOAA）及其机构（NWS、NDBC、CO-OPS），属公有领域。这些来源并不为 SeaWindow 背书。

我们的内容

本 App 及其设计、代码、名称与标识归 Mitux LLC 所有，属于各自所有者的第三方数据和材料除外。本条款 不授予你对我们品牌的任何权利。

免责声明

本 App 按「现状」和「现有可用」提供，在法律允许的最大范围内，不作任何明示或默示的保证，包括对特定 用途的适用性和数据准确性的保证。

责任限制

在法律允许的最大范围内，Mitux LLC 不对任何间接、附带或后果性损失负责，也不对因你使用或依赖本 App 或其数据（包括任何出海决定）而产生的损失或损害负责。本条款不限制依法不可限制的责任。

赔偿

你同意承担因你滥用本 App 或违反本条款而产生的合理索赔与费用。

变更与终止

我们可随时更改、暂停或停止本 App 或任何功能。若你违反本条款，我们可终止你的访问。你可随时停止使用 本 App。

Apple App Store

若你在 Apple 设备上使用 SeaWindow，本条款仅存在于你与 Mitux LLC 之间，而非 Apple；Apple 不对本 App 或其内容负责，也没有提供维护或支持的义务。在法律允许的最大范围内，Apple 对本 App 不承担保证义务； 对付费 App，若其不符合任何适用保证，你可通知 Apple，Apple 可退还购买价款，除此之外 Apple 不承担其他 保证义务。对于本 App 或你的使用侵犯知识产权的任何主张，Apple 不负责处理。你声明你不位于受美国政府禁运 或被指定为「支持恐怖主义」的国家/地区，且不在任何美国政府的禁止或受限方名单上。Apple 及其子公司是本 条款的第三方受益人，有权对你执行本条款。

管辖法律

本条款受美国加利福尼亚州法律管辖，不适用其冲突法规则。

条款变更

本条款如有变更，上方的「最后更新」日期会随之更新。变更后继续使用本 App，即表示你接受更新后的条款。
