Terms of Use

These Terms of Use (the “Terms”) are the agreement and end-user licence between you andMitux LLC (“we”, “us”), the maker of SeaWindow, for your use of the app. By downloading or using SeaWindow, you agree to these Terms. If you do not agree, do not use the app.
Your licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to useSeaWindow on devices you own or control, for your own non-commercial use, subject to these Terms and the app store’s rules.
Your account
An account is optional. If you create one, you are responsible for the activity under it. Tell us promptly if you believe it has been used without your permission. You may delete your account at any time — see the Privacy Policy.
Acceptable use
Please do not misuse the app: do not attempt to break, overload, or gain unauthorized access to it or our servers; do not reverse-engineer or copy it except as the law allows; and do not use it to break the law. We may suspend access that threatens the service or other users.
Subscriptions and payments
We may offer paid features or auto-renewing subscriptions in the future. If we do, the price and what is included will be shown in the app before you buy. Payment is charged to your Apple App Store or Google Play account when you confirm the purchase.
Auto-renewing subscriptions renew automatically for the same period unless you cancel at least 24 hours before the current period ends, and your account is charged for renewal within 24 hours before the period ends. You can manage or cancel a subscription anytime in your App Store or Google Play account settings; cancellation takes effect at the end of the current period. Any unused portion of a free period is forfeited when you buy a subscription. Refunds are handled by Apple or Google under their policies; we generally cannot issue store refunds directly.
Data sources and attribution
Weather data is provided by Open-Meteo.com under CC-BY 4.0. Buoy, tide and marine-warning data are from the U.S. National Oceanic and Atmospheric Administration (NOAA) and its services (NWS, NDBC, CO-OPS) and are in the public domain. These sources do not endorse SeaWindow.
Our content
The app, its design, code, name and marks belong to Mitux LLC, except for third-party data and materials that belong to their owners. These Terms do not give you rights in our brand.
Warranty disclaimer
The app is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and accuracy of data, to the fullest extent the law allows.
Limitation of liability
To the fullest extent permitted by law, Mitux LLC will not be liable for any indirect, incidental, or consequential loss, or for loss or damage arising from your use of — or reliance on — the app or its data, including any decision to go out on the water. Nothing in these Terms limits liability that cannot be limited by law.
Indemnity
You agree to cover reasonable claims and costs that arise from your misuse of the app or your breach of these Terms.
Changes and termination
We may change, suspend, or discontinue the app or any feature at any time. We may end your access if you breach these Terms. You may stop using the app at any time.
Apple App Store
If you use SeaWindow on an Apple device, these Terms are between you and Mitux LLC only, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support. To the maximum extent permitted by law, Apple has no warranty obligation for the app; for a paid app, if it fails to conform to any applicable warranty you may notify Apple and Apple may refund the purchase price, and Apple has no other warranty obligation. Apple is not responsible for addressing any claim that the app or your use of it infringes intellectual-property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated “terrorist-supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Governing law
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws rules.
Changes to these Terms
If these Terms change, the “last updated” date above changes with it. Continuing to use the app after a change means you accept the updated Terms.
